Dever – Has any Board member been contacted by anyone, in any way, in relation to any of the applications before us tonight? I mean by email, phone, letters, conversations or any other way trying to get your opinion on how you would vote?  All Board members said no.

Clark moved, Pelczar seconded, THAT WE APPROVE THE MINUTES, August 8, 2013.  Voted 3-0 in favor.

PUBLIC HEARING

           3030: 185 Realty Trust: An appeal for a SPECIAL EXCEPTION (ARTICLE VIII-Definition - setbacks) to allow off street parking within the front setback, Tax Map S25, Lot 11A, located on Waukewan Street in the B/I District.  CONTINUED FROM 8/8/2013.

           Carl Johnson – Advanced Land Surveying Consultants, Inc. – This project involved both Zoning and Site Plan approval back in 2011.  We received conditional approval from the Planning Board and received approval from the Zoning Board in 2011. Subsequent to that hearing, the owner had a tenant lined up for the building with a long lease but the tenant went away and the owner got involved in a restoration project with wetlands that were disturbed by a prior owner which caused the delay in proceeding with the Site Plan. So the Special Exception that was granted on 8/11/2011 has lapsed. The owner is now ready to proceed with the Site Plan.  We have to go down the check list on the conditional approval and one of those is the parking indicated in the front setback would require a Special Exception. That is why we are here. It was granted in 2011. We are asking for exactly the same thing that we asked for in 2011. Nothing has changed. I will highlight the criteria for granting a Special Exception.  The use will not be detrimental to the character or enjoyment of the neighborhood. There will be a landscape buffer between the road and the parking area. The use will not be injurious, noxious or offensive to the neighborhood. Parking in the area shown is the least impacting alternatives as it will be in an already disturbed area and not affect the recently restored non-designated wetlands in the back portion of the lot. The use will not be contrary to public health, safety or welfare by reason of undo traffic or congestion, unhealthy or unsanitary conditions. Site Plan and Architectural Design Review was presented to the Planning Board on May 24, 2011 and continued to June 28 and approved with conditions on July 26, 2011.  For those reasons that were stated just now we feel we meet the criteria for a Special Exception. Hearing closed at 7:15 PM.

           3031: David & Susan Eaton: An appeal for a VARIANCE ( ARTICLE V- D-4(B )to construct a new single family residence with a front setback of 44.5’, 65’ required, a side setback of 12.2’, 20’ required and 37.4% lot coverage, 30% allowed, Tax Map U26, Lot No. 14, located at 79 Cummings Cove Road in the Shoreline District. 3032: Brian Allen: An appeal for a SPECIAL EXCEPTION (ARTICLE V, SECTION D9 G4a) for the undertaking of a use not otherwise permitted in the protective buffer to construct a building, associated parking and utilities within the protective buffer, Tax Map S15, Lot No. 12, located at 422 Daniel Webster Highway in the Central Business District. CONTINUED TO OCTOBER 10, 2013

3033: Advanced Land Surveying Consultants for Wayne Ahlquist Jr.: An appeal for a SPECIAL EXCEPTION (ARTICLE V, SECTION D9 G4a) for the undertaking of a use not otherwise permitted in the protective buffer to construct a pedestrian and recreational vehicle bridge with no wetland impact and 544 sf. buffer impact, Tax Map S19, Lot No. 5 located at 12 Latchkey Lane in the Commercial Route 3 South District. CONTINUED TO OCTOBER 10, 2013

 

3034: Case & Keg dba Harshil, inc.: An appeal for a SPECIAL EXCEPTION (ARTICLE V, SECTION D9 G4a) for the undertaking of a use not otherwise permitted in the protective buffer to expand the store by 425 sf. which will be in the buffer and not the non-designated wetland, Tax Map U06, Lot No. 139A located at 5 Mill Street in the Central Business District. CONTINUED TO OCTOBER 10, 2013

           Clark – I don’t see a problem with this. Pelczar agreed with Warren.

 

           Clark moved, Pelczar seconded, IN CASE # 3030,185 Realty Trust, I MOVE THE APPEAL FOR A SPECIAL EXCEPTION (ARTICLE VIII-DEFINITION - SETBACKS) TO ALLOW OFF STREET PARKING WITHIN THE FRONT SETBACK, TAX MAP S25, LOT 11A, LOCATED ON WAUKEWAN STREET IN THE B/I DISTRICT BE GRANTED, AS IT MEETS THE CRITERIA FOR A SPECIAL EXCEPTION.  Voted 3-0 in favor.
